Terms and Conditions of Movendo Concept

1. Definitions
In these general terms and conditions of sale, the following terms have the meanings ascribed below:
Movendo Concept: refers to our company, the supplier of products and services.
Client: refers to any entity placing an order with Movendo Concept.
Products: refers to the goods and services provided by Movendo Concept.
Order: refers to any purchase request for products or services made by the client from Movendo Concept.
2. Order Confirmation
Timeframe and deemed acceptance in the absence of objection: In the absence of a written objection within 48 business hours following receipt of the confirmation, the order shall be deemed accurate and accepted in all its terms and conditions.
3. Return Policy
Return Period: Return requests must be made within 30 days of receiving the products. After this period, goods are no longer eligible for return or exchange.
Inspection and Credit: A credit will only be issued after inspection of the returned items to ensure they are undamaged and in their original packaging.
Restocking Fees: Restocking fees may apply in cases of unused returns, order cancellations after confirmation, or items no longer covered by warranty.
Custom Products: Returns of custom-made products may be refused at Movendo Concept’s discretion. Special orders are non-returnable and non-refundable.
4. Exchange Policy
Exchange Period: Exchange requests must be made within 30 days of receiving the products.
Custom Products: Exchanges of custom-made products may be refused at Movendo Concept’s discretion.
5. Claims Upon Delivery
Claim Period: Clients have 30 days from receipt of their order to report any issue, missing item, or identified defect.
6. Product Warranty
Defects: Movendo Concept products are covered by a lifetime warranty for manufacturing defects. Manufacturer warranties apply to other distributed products. Defective items under warranty will be replaced—no credit will be issued.
7. Payment Terms
Payment Deadline: Payment must be made within 30 days from the date of invoice.
Late Payment Penalties: A grace period of 5 calendar days applies after the due date. After this grace period, interest of 2% per month (approximately 0.066% per day) will apply, calculated daily on the unpaid balance until full payment is received.
Payment Upon Receipt Policy: If payment deadlines are frequently exceeded, Movendo Concept reserves the right to request payment upon order receipt or upon delivery. New clients must pay for their first three (3) orders at the time of order confirmation.
8. Shipping and Delivery
Shipping Fees: Shipping is included for orders of CAD 5,000 or more.
Responsibility: Responsibility and risk are transferred to the client once the goods leave Movendo Concept’s warehouse.
9. Governing Law and Jurisdiction
Applicable Law: These terms and conditions are governed by the laws of the Province of Québec.
Jurisdiction: Any dispute relating to these conditions shall fall under the exclusive jurisdiction of the courts of Québec.
10. Back Charges
No back charges will be accepted by Movendo Concept.
11. Final Provisions
Amendment of Terms: Movendo Concept reserves the right to modify these general conditions at any time. The updated conditions will apply to all orders placed after their publication on our website.
Acceptance of Terms: By placing an order with Movendo Concept, the client unreservedly accepts these general terms and conditions of sale.
